Is it legal to use certain songs in a fangame?

I am making a videogame. It half of the songs are from Sonic the Hedgehog (the most recent song I will be using is "Dark Gaia" from Sonic Unleashed.) and half are from Dragonball Z. I stated in the game's opening video "This is a non-profit fangame", "All copyrights go to their rightful owners", and I even did what they do in sprite movies where they show the SEGA logo. There are only about 16 tracks in total(half of which made before 2006), but in spite of this, can I still get sued?
